The Global Fund to Fight AIDS, Tuberculosis and Malaria, a multi-stakeholder international financing institution duly formed as a non-profit foundation under the laws of Switzerland and recognized as an international organization by various national governments (referred to as “the Global Fund”, “we” or “us”), provides the Website located at (the “Website”) subject to your compliance with all the terms, conditions and notices contained or referenced in the Website’s Terms of Use (the, “Terms of Use”).

This Privacy Policy describes the types of information we may collect from you or that you may provide to us when you visit the Website, and our practices for collecting, using, maintaining, protecting and disclosing such information. This Privacy Policy applies to information we collect: (i) through the Website, (ii) in text and electronic messages between you and the Website, and (iii) applications you download from the Website. This Privacy Policy does not apply to any information collected offline (e.g., letter, telephone, fax or voicemail), through electronic messages between you an email address that does not have the same domain name as the Website, or via third-party sites that may be accessed through hyperlinks on the Website, such as information provided to the Global Fund in connection with the whistle-blowing activities defined under the Whistle-blowing Policy and Procedure of the Global Fund to Fight AIDS, Tuberculosis and Malaria, as amended from time to time (the “Whistle-blowing Policy and Procedure”), which is governed by the Whistle-blowing Policy and Procedure and other privacy policies, where applicable.

The Website collects several types of information about visitors and/or users. Information may either be collected directly when you provide it to us or automatically as you navigate through the Website.

(a) Personally Identifiable Information. “Personally Identifiable Information” refers to information by which you may be personally identified, such as your name or email address. We will collect and process such data about you if you register or create an account, subscribe to a newsletter, submit feedback, fill out a survey, or send us a communication. You may also provide information to be published or displayed (“posted”) on public areas of the Website (such as blogs, forums, message boards, and the like), or transmitted to other users of the Website using ‘sharing’ features (collectively, “User Contributions”). Your User Contributions are posted and transmitted to others at your own risk. We cannot control the actions of other users of the Websites with whom you may choose to share your User Contributions.

We may also collect your Internet Protocol (‘IP’) address. We use your IP address to diagnose problems with our servers, software, to administer our Website and to gather demographic information.

We do not collect more Personally Identifiable Information than is reasonably necessary to participate in an activity on the Website.

(b) Non-Personally Identifiable Information. We may collect certain Non-Personally Identifiable Information that does not by itself identify a specific individual. Such information tells us about your equipment, browsing actions, the resources that you access and use through the Website, your operating system and browser type. The information that we collect automatically is “statistical” in nature. It helps us to deliver a better and more personalized service to users, by enabling us to estimate usage patterns and customize the Website according to your individual preferences.


The data that we collect from you may be transferred to, and stored at, or processed at, a country whose laws have not been recognized as ensuring adequate safeguards for the protection of personal data by the European Commission or Switzerland. The Global Fund will analyze browsing patterns and usage trends of Website visitors and users with the general information collected. The Global Fund reserves the right to use personal information in order to tailor the Website to your specific needs, offer information that may be of interest to you, for analysis and other institutional purposes.


We do not sell, trade, rent or disclose your information to others, except as provided herein:

(a) We will disclose Personally Identifiable Information in the following circumstances: (i) if it is required by a competent authority, or to cooperate with an investigation of potential illegal activities such as fraud or other violations; (ii) if we have a good faith belief that it is required or permitted under applicable law; (iii) to protect the rights, reputation, property or safety of us or other parties; (iv) to defend or enforce our rights or your obligations, including those under the Website’s Terms of Use; or (v) with your prior consent to do so.

(b) We may provide Non-Personally Identifiable Information about your usage patterns, and related Website information to our third-party providers.


All information you provide to us is stored on secure servers.

Where access to or use of the Website by you is available only through a registered account, associated with a username and password selected by you, we recommend that you do not divulge your password to anyone, that you change your password often using a combination of letters and numbers, and that you ensure you use a secure web browser. We cannot be held accountable for activity that results from your own neglect to safeguard the secrecy of your password and user name. If you share a computer with anyone, you should always log out of your account after you are finished, in order to prevent access to your information from subsequent users of that computer. Please notify us as soon as possible if your user name or password is compromised.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, you acknowledge that: (a) there are security and privacy limitations of the Internet, which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Website cannot be guaranteed and we shall have no liability to you or any third party for loss, misuse, disclosure or alteration of such information; and (c) any such information and data may be viewed or tampered with in transit by a third party.

In the unlikely event that we believe that the security of your Personally Identifiable Information in our control may have been compromised, we will notify you as promptly as possible under the circumstances. To the extent we have your e-mail address, we may notify you by e-mail and you consent to our use of e-mail as a means of such notification.

The Global Fund is not responsible for the privacy practices of or the content found on external or third-party websites, nor does this Privacy Policy cover the information that may be collected on such external or third-party websites. The appearance of such external links on the Website does not represent the Global Fund’s endorsement or affiliation with the views and content found on the external websites. Visitors should review the individual privacy practices of external or third-party websites before accessing such websites as they may differ from the terms and conditions of this Privacy Policy.


Any amendments to our Privacy Policy will be posted on this page (with a notice that the Privacy Policy has been updated on the home pages of the Websites). The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for periodically visiting our Websites and this Privacy Policy to check for any changes.

Your continued access and use of the Website after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by the modified Privacy Policy.

The official, legally enforceable language of this document shall be English. Any question of interpretation shall be resolved based on the English version of this Privacy Policy and you agree that this Privacy Policy be provided exclusively in the English language.


This Privacy Policy shall be governed by the UNIDROIT Principles (2004).


Any dispute, controversy or claim arising out of or related to this Privacy Policy or the breach, termination or invalidity thereof or to any use of the Website by the Visitor or of the content available therein and the applicable licenses, shall be settled by arbitration in accordance with the United Nations Commission on International Trade Law (UNCITRAL) Arbitration Rules. The Global Fund and the Visitor agree to be bound by the arbitration award rendered as a final adjudication. The appointment authority of such arbiter shall be the International Chamber of Commerce International Court of Arbitration. The number of arbitrators shall be one. The place of arbitration shall be Geneva, Switzerland. The language used in the arbitral proceedings shall be English.
